An organisation is required under GDPR to inform you if they have breached your personal data in any way, and typically the first you might hear about it would be an email from the company concerned. Despite this, you may not know about a data breach by a particular company until you hear that they have been fined by the Information Commissioner’s Office ICO. When you contact us, we’ll get in touch with the company in question and use any information available from the ICO to establish whether your data has been breached.

If an organisation has failed to protect your data, you are entitled to claim compensation regardless of whether you have suffered any losses or not. We can make a claim on your behalf for anguish or anxiety caused by a data breach, but if you have suffered financial harm as a direct result of the breach, the amount of compensation you might be able to claim would likely be far greater..

Each data breach claim will be looked at on its own merits, but in most cases where a claim for distress has been made, the minimum level of damages would usually be in the region of a £1,000. Much depends on the circumstances of the breach and any impact. Where the data breach has caused significant financial loss or the leak of highly sensitive personal data, then the level of compensation could be significantly higher.
